An Edo State High Court, sitting in Benin City, has moved to regularize the suit filed by several suspended Enigie (Benin Dukes) challenging their removal from office by His Royal Majesty, Oba Ewuare II, CFR, the Oba of Benin.
The suspension of the Enigie last year was based on allegations of rebellion against the Benin monarchy.
At Thursday’s session, the court, presided over by Justice Mary Asemota, granted three separate applications relating to the case.
One of the key applications came from Kingsley Obamogie (SAN), lead counsel for the Oba of Benin and 1st Defendant, who sought an extension of time to file a preliminary objection challenging the competence of the suit.
The suit in question was brought by the suspended Enigie — Prof. Gregory Akenzua, former Enogie of Evbuobanosa Dukedom, and Mr. Edomwonyi Ogiegbaen, former Enogie of Egbaen Siluko Dukedom.
Justice Asemota also granted a counter affidavit submitted by the Benin Traditional Council (BTC), which opposed the claims of the suspended * Enigie in the suit, marked B/250os/2023. At the sitting, the Edo State Attorney General, Oluwole Osaze-Uzzi (SAN), was represented by E. B. Akhimien, Esq.
The claimants, represented by their lead counsel, Dr. Osagie Obayuwana, requested an extension of time to respond to the counter affidavit filed by the Benin Traditional Council.
Benedicta Okoduwa, representing the BTC, appeared in court to argue the council’s application, which was also considered by Justice Asemota. The case has been adjourned to December 2, 2024, for hearing.
The suit, originally in the court of Justice Peter Akhihiero, had been scheduled for mention on October 17, 2024, but was reassigned to Justice Asemota’s court following a routine shuffle of court assignments.
The courtroom and its surroundings were filled with supporters of Oba Ewuare II, including members of the Benin Royal Family, led by Prince Aghatise Erediauwa, loyal Enigie, and numerous Edo sons and daughters who turned out in solidarity with the monarch.
